Regulator / body
The Federal Network Agency (Bundesnetzagentur, BNetzA) is the central market-surveillance authority, single contact point and complaints body under the KI-MIG. The Federal Financial Supervisory Authority (BaFin) covers AI tied to regulated financial activity. The Federal Office for Information Security (BSI) is the interim notifying authority, the German Accreditation Body (DAkkS) handles accreditation, and the Federal Commissioner for Data Protection and Freedom of Information (BfDI) oversees data protection. The Länder supervise their own public bodies and media-related AI.
Status
Germany has implemented the EU AI Act through the KI-MIG, in force since 2026-07-29, with the Bundesnetzagentur as lead supervisor.

Key instruments

Germany does not have a separate national AI regulation; it implements the EU AI Act (Regulation (EU) 2024/1689) through a national implementing act.

  • KI-MIG(the implementation act, Federal Law Gazette 2026 I No. 139; in force 2026-07-29). It designates the competent authorities and sets up an independent KI-Marktüberwachungskammer (AI market-surveillance chamber) within the Bundesnetzagentur. A coordination centre (KoKIVO), a KI-Service Desk and a mandate for a regulatory sandbox (Reallabor) are live.
  • AISI Deutschland(established 2026-08-31 by the digital ministry BMDS and the interior ministry BMI). Phase 1 is a virtual nucleus drawing on the BSI and the Bundesnetzagentur.
  • Draft Digital Media State Treaty(discussion draft published about 2026-09-28 by the Länder). It adds a category of “KI-Informationssysteme” (AI information systems) with transparency duties.

Scope: who and what is covered

The KI-MIG allocates supervision of the EU AI Act among German authorities: the Bundesnetzagentur in general, BaFin for AI used in regulated financial activity, and the Länder for their own public bodies and for media-related AI. The draft State Treaty would add transparency duties for AI-based information systems in the media sphere.

Compliance and enforcement

Companies should identify which authority supervises their AI systems and use the Bundesnetzagenturas the single contact point and complaints body. The AI Act's own obligations and fines, described on the European Union page, apply in Germany through this structure.
